This is an Addendum to the Komatsu New Zealand Limited (Komatsu) Account Application Form (Account Form) with the Applicant. Capitalised terms not defined in this Addendum have the meaning given in the Account Form. The terms and conditions of this Addendum will apply if the Applicant requests access to myKomatsu with a Komatsu Premium Online Account to purchase Goods from Komatsu and agrees that:
1. All orders placed on myKomatsu (https://my.komatsu.co.nz) will be subject to Komatsu Online’s Terms of Use (a copy of which is available on the applicable website).
2. Invoiced amounts for all orders placed on myKomatsu will be charged to your Komatsu Account with payment for these invoices being due in accordance with the payment terms of your Komatsu Account.
3. They have full responsibility for the safeguarding of the username and password it has established to access myKomatsu and will not divulge these details to any unauthorised third party.
4. The email address provided below is the email address of the user who has been authorised as the Primary Administrator of the Komatsu Premium Online Account.
5. They will provide all the necessary information (including valid purchase order numbers) to Komatsu that it would otherwise provide when placing orders with Komatsu via any other means (i.e. by telephone, in person at a Komatsu branch or otherwise) and it is their own responsibility to ensure payment is made to Komatsu whether or not a valid purchase order number has been provided by the user of the myKomatsu website.
6. In the event of any inconsistency between these terms and conditions and the terms and conditions of the Account Form, the terms and conditions of the Account Form will prevail to the extent of any inconsistency.
